A\u015fa\u011f\u0131da imzas\u0131 bulunan insan haklar\u0131 \u00f6rg\u00fctleri olarak bu metni, \u00e7al\u0131\u015fmalar\u0131 tamamlanan Milli Dayan\u0131\u015fma, Karde\u015flik ve Demokrasi Komisyonu taraf\u0131ndan haz\u0131rlanmakta olan ortak raporda yer almas\u0131; ayr\u0131ca T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi\u2019nin bu komisyon raporu do\u011frultusunda g\u00fcndemine alaca\u011f\u0131 yasal d\u00fczenlemelerde de\u011ferlendirmesi gereken talep ve \u00f6nerilerimizi sunmak amac\u0131yla kamuoyuyla payla\u015f\u0131yoruz.<\/p>\n\n\n\n<p>T\u00fcrkiye\u2019de yakla\u015f\u0131k y\u00fcz y\u0131ll\u0131k bir ge\u00e7mi\u015fe sahip olan K\u00fcrt meselesi; yaln\u0131zca g\u00fcvenlik eksenli bir sorun de\u011fil, ayn\u0131 zamanda kimlik, dil, k\u00fclt\u00fcr, inan\u00e7 ve temel haklar ba\u011flam\u0131nda derin yap\u0131sal e\u015fitsizlikler do\u011furan bir insan haklar\u0131 meselesidir. Bu sorun alan\u0131, ge\u00e7mi\u015ften bug\u00fcne yaln\u0131zca toplumun geni\u015f kesimlerini de\u011fil, ayn\u0131 zamanda bu ihlalleri g\u00f6r\u00fcn\u00fcr k\u0131lmaya \u00e7al\u0131\u015fan \u00e7ok say\u0131da insan haklar\u0131 savunucusunu da do\u011frudan hedef haline getirmi\u015ftir. \u0130nsan haklar\u0131 savunucular\u0131n\u0131n ya\u015fam\u0131n\u0131 yitirdi\u011fi, \u00f6zg\u00fcrl\u00fcklerinden yoksun b\u0131rak\u0131ld\u0131\u011f\u0131 ve a\u011f\u0131r bask\u0131lara maruz kald\u0131\u011f\u0131 bir tarihsel tablo ise bu ger\u00e7e\u011fin a\u00e7\u0131k g\u00f6stergesidir.<\/p>\n\n\n\n<p>\u0130HSDA olarak vurgulamak isteriz ki; kal\u0131c\u0131 bar\u0131\u015f ve toplumsal huzur, ancak demokrasinin g\u00fc\u00e7lendirilmesi ve insan haklar\u0131n\u0131n eksiksiz bi\u00e7imde g\u00fcvence alt\u0131na al\u0131nmas\u0131yla m\u00fcmk\u00fcnd\u00fcr. Bu ba\u011flamda T\u00fcrkiye\u2019nin, taraf\u0131 oldu\u011fu uluslararas\u0131 insan haklar\u0131 s\u00f6zle\u015fmelerine ve \u00f6zellikle Avrupa \u0130nsan Haklar\u0131 Mahkemesi kararlar\u0131na uyum y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc yerine getirmesi, demokratik hukuk devleti ilkesinin gere\u011fidir.<\/p>\n\n\n\n<p>T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi\u2019nin, T\u00fcrkiye\u2019de insan haklar\u0131 savunucular\u0131n\u0131n g\u00fcvenli ve \u00f6zg\u00fcr bi\u00e7imde \u00e7al\u0131\u015fmalar\u0131n\u0131 sa\u011flamak amac\u0131yla ifade, \u00f6rg\u00fctlenme ve bar\u0131\u015f\u00e7\u0131l toplanma \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc koruma alt\u0131na alan a\u00e7\u0131k ve ba\u011flay\u0131c\u0131 yasal reformlar\u0131 gecikmeksizin hayata ge\u00e7irmesi gerekmektedir. Bu kapsamda, insan haklar\u0131 savunuculu\u011fu faaliyetlerinin kriminalize edilmesine yol a\u00e7an Ter\u00f6rle M\u00fccadele Kanunu ve T\u00fcrk Ceza Kanunu ba\u015fta olmak \u00fczere mu\u011flak yasal d\u00fczenlemeler hak temelli bi\u00e7imde yeniden ele al\u0131nmal\u0131; tutuklama ve adli kontrol tedbirlerinin hukuka ayk\u0131r\u0131 uygulamalar\u0131na son verilmelidir.&nbsp;<\/p>\n\n\n\n<p>\u0130nsan haklar\u0131 ihlallerini izleyen, belgeleyen ve takip eden avukatlar, gazeteciler, akademisyenler, ba\u011f\u0131ms\u0131z g\u00f6zlemciler ve sivil toplum temsilcilerinin mesleki ve savunuculuk faaliyetleri nedeniyle hedef al\u0131nmalar\u0131na, kriminalize edilmelerine ve yarg\u0131sal\/idari bask\u0131ya maruz b\u0131rak\u0131lmalar\u0131na son verilmelidir.&nbsp;<\/p>\n\n\n\n<p>\u0130nsan haklar\u0131 \u00f6rg\u00fctlerine y\u00f6nelik idari taciz ve bask\u0131lar\u0131n sona erdirilmesi i\u00e7in derneklerin kapat\u0131lmas\u0131, faaliyetlerinin durdurulmas\u0131, y\u00f6neticilerinin g\u00f6revden uzakla\u015ft\u0131r\u0131lmas\u0131 ve mali-idari denetim s\u00fcre\u00e7lerinde idareye ve yarg\u0131ya tan\u0131nan geni\u015f takdir yetkisini daraltan ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesini zedelemeyecek yasal g\u00fcvencelerin hayata ge\u00e7irilmesi gerekmektedir. Sivil toplum \u00f6rg\u00fctleri hakk\u0131nda al\u0131nan idari ve yarg\u0131sal kararlara kar\u015f\u0131 h\u0131zl\u0131, etkili ve eri\u015filebilir yarg\u0131sal ba\u015fvuru yollar\u0131 g\u00fcvence alt\u0131na al\u0131nmal\u0131d\u0131r.<\/p>\n\n\n\n<p>\u0130nsan haklar\u0131 savunucular\u0131na y\u00f6nelik tehdit ve sald\u0131r\u0131lara kar\u015f\u0131 \u00f6zel bir koruma ve erken m\u00fcdahale mekanizmas\u0131 olu\u015fturulmal\u0131; bu ihlallerde cezas\u0131zl\u0131kla etkin bi\u00e7imde m\u00fccadele edilmelidir. T\u00fcm bu ad\u0131mlar, insan haklar\u0131n\u0131 merkeze alan, bar\u0131\u015f\u0131 ve demokrasiyi kal\u0131c\u0131 k\u0131lacak bir toplumsal d\u00fczenin in\u015fas\u0131 i\u00e7in vazge\u00e7ilmezdir.<\/p>\n\n\n\n<p>Bu \u00e7er\u00e7evede T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi b\u00fcnyesinde y\u00fcr\u00fct\u00fclmekte olan bar\u0131\u015f ve demokrasi odakl\u0131 \u00e7al\u0131\u015fmalar\u0131n; g\u00fcvenlik\u00e7i yakla\u015f\u0131mlar\u0131n \u00f6tesine ge\u00e7erek, insan haklar\u0131n\u0131 \u00f6nceleyen, temel hak ve \u00f6zg\u00fcrl\u00fckleri geni\u015fleten ve kimlik, dil ve k\u00fclt\u00fcr temelli sorunlar\u0131 ortadan kald\u0131rmay\u0131 hedefleyen bir anlay\u0131\u015fla ele al\u0131nmas\u0131 gerekti\u011fini d\u00fc\u015f\u00fcn\u00fcyoruz. Bu s\u00fcre\u00e7, yaln\u0131zca yasal d\u00fczenlemelerle s\u0131n\u0131rl\u0131 kalmamal\u0131; hakikatle y\u00fczle\u015fme, toplumsal onar\u0131m ve demokratik kat\u0131l\u0131m ilkelerini de i\u00e7ermelidir.<\/p>\n\n\n\n<p>\u00d6te yandan T\u00fcrkiye\u2019de bar\u0131\u015f ve demokrasinin s\u00fcrd\u00fcr\u00fclebilir bi\u00e7imde tesis edilmesi, b\u00f6lgesel ger\u00e7ekliklerden ba\u011f\u0131ms\u0131z d\u00fc\u015f\u00fcn\u00fclemez. Bu kapsamda, T\u00fcrkiye\u2019nin kom\u015fu co\u011frafyalarda, \u00f6zellikle Kuzey Do\u011fu Suriye b\u00f6lgesinde ya\u015fayan K\u00fcrtlerin temel haklar\u0131na sayg\u0131 temelinde bir yakla\u015f\u0131m geli\u015ftirmesi; bar\u0131\u015f\u00e7\u0131l, demokratik ve insan haklar\u0131na dayal\u0131 bir gelecek i\u00e7in \u00f6nem ta\u015f\u0131maktad\u0131r. Zira insan haklar\u0131 evrensel olup s\u0131n\u0131rlarla s\u0131n\u0131rland\u0131r\u0131lamaz.<\/p>\n\n\n\n<p>\u0130nsan Haklar\u0131 Savunucular\u0131 Dayan\u0131\u015fma A\u011f\u0131 olarak, bar\u0131\u015f\u0131n inkarla de\u011fil haklar\u0131n tan\u0131nmas\u0131yla, g\u00fcvenli\u011fin bask\u0131yla de\u011fil demokratik hukukla, toplumsal birli\u011fin ise e\u015fitsizlikle de\u011fil adalet ve \u00f6zg\u00fcrl\u00fckle sa\u011flanabilece\u011fini bir kez daha vurguluyoruz.
